A BILL to amend article five-a, chapter seventeen-c of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section five, relating to administrative sanctions for driving under the influence (DUI).

Be it enacted by the Legislature of West Virginia:
That article five-a, chapter seventeen-c of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section five, to read as follows:
ARTICLE 5A. ADMINISTRATIVE PROCEDURES FOR SUSPENSION AND
REVOCATI ON OF LICENSES FOR DRIVING UNDER THE INFLUENCE OF ALCOHOL, CONTROLL ED SUBSTANC ES OR DRUGS.

§17C-5A-5. Administrative sanctions for DUI; special plates.

(a) If the commissioner finds that a person has been convicted of any violation of section two, article five-a, of this chapter, or under any statute of the United States, or any other state, of an offense which has the same elements as an offense described in this article, for conduct which occurred within a period of the previous five years, the commissioner shall require the person to purchase, display and use a special registration plate in order to register and operate a motor vehicle in this state. The plate shall be used for a period of one year from the date of initial registration. No registration plate, other than described in this section, may be issued to or for any vehicle owned by the person for a period of one year.
(b) All of the special plates provided in this section shall be of such form and design as to include in bold black lettering the alphabetic letters "DUI" and include a distinguishing number to be assigned by the commissioner and shall be of the same size as regular registration plates as well as contain any such other words and figures as the commissioner shall prescribe.



NOTE: The purpose of this bill is to require persons convicted of DUI offenses to purchase and use for one year, special license plates indicating they are a DUI offender.
